Labor guarantees: Do mobilized individuals retain their jobs and salaries?

The government is currently providing monthly cash payments.

For mobilized Ukrainians, not only the workplace and position were preserved until a certain date, but also their salary. However, after July 19, 2022, the financial payments that were previously provided were canceled, and instead, a monetary allowance from the state budget was established.

According to Victoria Ohorodnik, a lawyer specializing in economic and labor law at the law firm "Prikhodko and Partners," reported by "RBK-Ukraine," the labor guarantees for mobilized Ukrainians are regulated by the Labor Code.

According to the article "Guarantees for Employees During the Performance of State or Public Duties," labor guarantees apply to employees who:

  • are assigned to undergo basic military service;
  • are called up for military service by the officer corps;
  • are conscripted for military service during mobilization;
  • are drafted into military service from reserves in a special period;
  • are accepted for military service under contract, including the signing of a new contract.

For the aforementioned individuals, until July 2022, their workplace, position, and average salary were preserved. However, after July 19 of the same year, the calculation of the average salary was canceled and replaced with:

  • payment of monetary support from the state budget of Ukraine;
  • regulation of payments in accordance with the Law of Ukraine "On Social and Legal Protection of Military Personnel and Their Families."

Additionally, starting from February 28, 2022, additional material support was introduced:

  • a reward of 30,000 hryvnias per month;
  • an increase in the reward to 100,000 hryvnias for those involved in combat actions.

Furthermore, the lawyer added that labor guarantees for such individuals remain in effect:

  • until the end of the special period;
  • until the actual date of dismissal;
  • until the completion of treatment (for the injured);
  • until their return from captivity.
